1. About Us

www.denisa.net ("DENISA", "we", "us", "our") is a website operated by Flair Furniture Ltd, a company registered in England and Wales under company number 07536751, with its registered office at Bedkingdom, Oldfield Lane, Heckmondwike, West Yorkshire, England, WF16 0JD. DENISA is a trading name of Flair Furniture Ltd.

2. These Terms

These terms and conditions ("Terms") apply to any order you place through www.denisa.net. Please read them carefully before ordering. By placing an order, you agree to be bound by these Terms. If you do not agree to these Terms, you must not place an order. We recommend you save or print a copy of these Terms for future reference.

We may amend these Terms from time to time. The Terms in force at the time you place your order will apply to that order.

Nothing in these Terms affects your statutory rights as a consumer, including your rights under the Consumer Rights Act 2015 and the Consumer Contracts (Information, Cancellation and Additional Charges) Regulations 2013.

3. Placing an Order

Our order process allows you to check and amend any errors before submitting your order. Please check your order carefully before confirming it.

After you place an order, you will receive an email acknowledging that we have received it. This does not mean your order has been accepted. Our acceptance of your order takes place when we send you an email confirming that the goods have been dispatched, at which point a contract is formed between you and us.

If we are unable to accept your order — for example because an item is out of stock, because we have identified an error in the price or description of the goods, or because we are unable to meet a delivery deadline — we will inform you of this and will not charge you, or will refund you in full where payment has already been taken.

4. Our Products

The images of products on our website are for illustrative purposes only. Although we make every effort to display colours accurately, we cannot guarantee that a device's display of the colours accurately reflects the colour of the products. Your product may vary slightly from those images.

All sizing and measurement information is provided as a guide only. Minor variations may occur.

5. Price and Payment

The price of the goods is as displayed on our website at the time you place your order and includes VAT (where applicable) at the applicable current rate chargeable in the UK. Delivery charges, where applicable, are shown separately before you confirm your order.

It is always possible that, despite our best efforts, some goods may be incorrectly priced. If the correct price at your order date is higher than the price stated to you, we will contact you for your instructions before we accept your order. We are under no obligation to provide goods at an incorrect (lower) price if the pricing error is obvious and could reasonably have been recognised by you as a mispricing.

Payment is taken at the time you place your order, via the payment methods shown at checkout. All payments are processed securely.

6. Delivery

Delivery costs and estimated timescales are displayed at checkout. Delivery estimates are given in good faith but are not guaranteed dates. If our supply of the goods is delayed by an event outside our control, we will contact you as soon as possible and take steps to minimise the effect of the delay. Provided we do this, we will not be liable for delays caused by the event, but if there is a risk of substantial delay you may contact us to end the contract and receive a refund for any goods you have paid for but not received.

The goods will be your responsibility from the time we deliver them to the address you gave us. You own the goods once we have received payment in full.

If no one is available at your address to take delivery, we or our courier will leave a note informing you of how to rearrange delivery or collect the goods. If, after a failed delivery, you do not rearrange delivery or collect the goods within a reasonable time, we may end the contract and refund you, less reasonable costs we have incurred.

7. Your Right to Cancel (Cooling-Off Period)

If you are a consumer, you have a legal right under the Consumer Contracts Regulations 2013 to change your mind and cancel your order within 14 days without giving any reason.

The cancellation period ends 14 days after the day on which you (or someone you nominate) receive the goods, or, where your order is delivered in instalments, 14 days after the day you receive the last instalment.

To exercise your right to cancel, you must inform us of your decision by a clear statement — for example by emailing denisa@denisa.net — before the cancellation period expires.

If you cancel, you must return the goods to us within 14 days of telling us you wish to cancel. Unless the goods are faulty or not as described, you are responsible for the cost of returning the goods. Goods should be returned unused, in their original condition and, where possible, in their original packaging.

We will refund you the price you paid for the goods, plus standard delivery charges (we are not required to refund any supplementary delivery costs if you chose a more expensive delivery option than our least expensive standard delivery). We may reduce your refund to reflect any reduction in the value of the goods caused by your handling of them beyond what is necessary to establish their nature, characteristics and functioning.

We will make the refund without undue delay and in any event within 14 days of the day we receive the goods back from you, or (if earlier) the day you provide evidence that you have sent the goods back. We will refund you using the same payment method you used, unless you agree otherwise.

8. Exceptions to the Right to Cancel

The right to cancel does not apply to:

  • goods that are made to your specifications or are clearly personalised;
  • goods which are sealed for health protection or hygiene reasons, once unsealed after delivery (for example, underwear, swimwear hygiene strips, pierced jewellery and similar items);
  • goods which become mixed inseparably with other items after delivery.

9. Faulty or Misdescribed Goods

We are under a legal duty to supply goods that are in conformity with the contract. Under the Consumer Rights Act 2015, goods must be as described, fit for purpose and of satisfactory quality. In summary, during the expected lifespan of your goods you are entitled to the following:

  • Up to 30 days: if your goods are faulty, you can get an immediate refund.
  • Up to six months: if your goods can't be repaired or replaced, then you're entitled to a full refund in most cases.
  • Up to six years: if your goods do not last a reasonable length of time, you may be entitled to some money back.

If you believe your goods are faulty or misdescribed, please contact us at denisa@denisa.net. Where goods are faulty or not as described, we will cover the reasonable cost of return.

10. Our Liability

If we fail to comply with these Terms, we are responsible for loss or damage you suffer that is a foreseeable result of our breach of these Terms or our failure to use reasonable care and skill. We are not responsible for any loss or damage that is not foreseeable.

We do not exclude or limit our liability where it would be unlawful to do so. This includes liability for death or personal injury caused by our negligence, for fraud or fraudulent misrepresentation, or for breach of your legal rights in relation to the goods.

We only supply goods via this website for domestic and private use. If you use the goods for any commercial, business or resale purpose, we will have no liability to you for any loss of profit, loss of business, business interruption or loss of business opportunity.

11. Intellectual Property

All content on this website — including the DENISA name and branding, text, designs, graphics, photography and imagery — is owned by or licensed to Flair Furniture Ltd and is protected by intellectual property laws. You may not reproduce, distribute or otherwise use any content from this website for commercial purposes without our prior written consent.

12. Your Personal Information

We only use your personal information in accordance with our Privacy Policy. Please take time to read it, as it includes important information about how we process your data.

13. Events Outside Our Control

We will not be liable or responsible for any failure to perform, or delay in performance of, any of our obligations under a contract that is caused by an event outside our reasonable control.

14. Other Important Terms

We may transfer our rights and obligations under these Terms to another organisation. You may only transfer your rights or obligations under these Terms to another person if we agree to this in writing.

Each of the paragraphs of these Terms operates separately. If any court or relevant authority decides that any of them is unlawful, the remaining paragraphs will remain in full force and effect.

If we do not insist immediately that you do anything you are required to do under these Terms, or if we delay in taking steps against you in respect of your breaking a contract, that will not mean that you do not have to do those things, and it will not prevent us taking steps against you at a later date.

15. Governing Law and Jurisdiction

These Terms are governed by English law and you can bring legal proceedings in respect of the goods in the English courts. If you live in Scotland, you can bring legal proceedings in either the Scottish or the English courts. If you live in Northern Ireland, you can bring legal proceedings in either the Northern Irish or the English courts.

Alternatively, you may be able to refer a dispute to alternative dispute resolution. Nothing in these Terms restricts your right to bring court proceedings.
